RedTond Security, LLC – Terms of Service
Effective Date: January 1, 2025
These Terms of Service ("Terms") govern your access to and use of the websites, applications, and services provided by RedTond Security, LLC ("RedTond," "we," "us," or "our"). By accessing or using our services, you agree to these Terms. If you are using the Services on behalf of a company, you represent that you are authorized to bind that company, and "you" refers to that company.
1. The Service
RedTond provides cloud-based software and APIs that simulate penetration tests and deliver security findings ("Services"). The Services are delivered through redtond.com or via direct contract.
2. Accounts and Access
You must be at least 18 years old and provide accurate registration information.
You are responsible for maintaining the confidentiality of your login credentials and any activity under your account.
RedTond may suspend or terminate accounts that violate these Terms or present security risks.
3. Acceptable Use
You agree not to:
Use the Services to attack, probe, or scan systems you do not own or have written authorization to test.
Interfere with other users or RedTond's infrastructure.
Reverse engineer, copy, or resell the Services without permission.
Use the Services in violation of any U.S. law or regulation.
We may suspend or disable access if we believe a violation has occurred.
4. Subscription and Payment
Self-serve users: Fees and billing frequency appear at checkout. Payments are processed through our authorized payment provider.
Contracted clients: Fees, term, and renewal are defined in the applicable Order Form or Statement of Work.
Subscriptions renew automatically unless canceled prior to renewal.
Prices may change with notice; continued use after notice constitutes acceptance.
5. Intellectual Property
All RedTond software, algorithms, documentation, and branding remain RedTond's property. You retain ownership of your own data and test results. Grant us a limited right to process your inputs solely to deliver the Services.
6. Confidentiality & Security
Each party agrees to protect any confidential information received from the other. RedTond implements commercially reasonable technical and organizational measures to secure data, but no system is perfectly secure.
7. Disclaimer of Warranties
The Services are provided "as is." RedTond disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
8. Limitation of Liability
To the fullest extent permitted by law, RedTond shall not be liable for indirect, incidental, or consequential damages. RedTond's total liability under these Terms shall not exceed the amount you paid to RedTond in the 12 months preceding the claim.
9. Indemnification
You agree to defend and indemnify RedTond from any claims or losses arising from your misuse of the Services or violation of these Terms.
10. Termination
You may stop using the Services at any time. We may suspend or terminate access for any material breach or if continued use could cause harm. Upon termination, your license ends but Sections 5–10 survive.
11. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. Venue for disputes lies exclusively in the federal or state courts located in that state.
